Terms of Service
Effective October 5, 2026
1. Agreement
These Terms of Service (the “Terms”) are an agreement between Hub5 (“we”, “us”) and the business or person that creates a Hub5 account (“you”, the “Customer”). By creating an account or using the Hub5 web app, mobile app, or customer portals (the “Service”), you agree to these Terms. If you accept on behalf of a company, you confirm you are authorized to bind it.
2. Accounts and team members
You are responsible for your account credentials and for everything done under your account, including by team members and crew you invite. Keep passwords confidential and tell us promptly about any unauthorized use. The account owner controls who has access and can remove users at any time.
3. Trials, plans and billing
New accounts may start with a free trial. When the trial ends, continued use of paid features requires an active subscription. Subscriptions renew automatically each billing period until cancelled, and fees are charged in advance through our payment processor. You can cancel at any time; cancellation takes effect at the end of the current period. Except where required by law, fees already paid are non-refundable. We may change prices with at least 30 days' notice before your next renewal.
4. Your data
You own the business data you put into Hub5 — clients, jobs, estimates, invoices, photos, timesheets and the like (“Customer Data”). You give us permission to host, process and display Customer Data only as needed to provide and support the Service. How we handle personal information is described in our Privacy Policy.
You are responsible for having the right to upload Customer Data and to contact your own customers and crew through the Service, including obtaining any consent required for email or text messages and for recording employee location while they are clocked in.
5. Acceptable use
You agree not to:
- use the Service for unlawful, deceptive or harassing purposes, or to send unsolicited bulk messages;
- upload malware or content you don't have the rights to;
- probe, disrupt or overload the Service, or access other customers' data;
- resell or copy the Service, or reverse-engineer it except where the law allows.
We may suspend accounts that violate these rules or put the Service or other customers at risk.
6. Third-party services
Some features rely on third parties, such as payment processing, email and text-message delivery, maps, and app stores. Your use of those features may also be subject to the third party's terms. We aren't responsible for third-party services we don't control.
7. Availability and changes
We work to keep the Service available and secure, but it is provided on an “as is” and “as available” basis. We may add, change or remove features; if we make a material change that reduces core functionality you pay for, we'll give reasonable notice.
8. Termination and data export
You may close your account at any time from Settings. We may terminate these Terms if you materially breach them and don't cure the breach after notice. You can export your Customer Data from Settings before closing your account. After closure we delete Customer Data from active systems, and from backups as they rotate out, except where we must keep records by law.
9. Disclaimers and limitation of liability
To the fullest extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. Neither party is liable for indirect, incidental, special, consequential or punitive damages, or lost profits or revenue. Our total liability arising out of these Terms is limited to the fees you paid us in the 12 months before the claim.
10. Indemnity
You will defend and indemnify us against third-party claims arising from your Customer Data, your messages to your customers or crew, or your violation of these Terms or the law.
11. Changes to these Terms
We may update these Terms. If a change is material, we'll notify account owners by email or in the app before it takes effect. Continuing to use the Service after the effective date means you accept the updated Terms.
